Welcome to Arabayaat.com. These Terms and Conditions
(“Terms”) govern your access to and use of our online marketplace services in
Jordan and abroad. By using our Website, registering an account, or making any
transaction, you agree to comply with and be legally bound by these Terms. If
you do not agree, you must stop using the Website immediately.
1. Definitions
- Marketplace
/ Platform: The online service provided by Arabayaat.com to
connect buyers and Vendors.
- Vendor:
Any person or entity listing products or services for sale.
- Buyer:
Any person or entity purchasing products or services.
- User:
Any visitor, Buyer, or Seller using the Website.
- Products
/ Services: Any goods, digital items, or services listed for sale on
the Platform.
2. Eligibility
- You
must be at least 18 years old to use the Platform.
- Businesses
must be legally registered in Jordan or in their respective country of
operation.
- By
registering, you confirm that the information you provide is accurate,
complete, and up to date.
3. User Accounts
- Each
User must register using a valid email & phone number
- You
are responsible for maintaining the confidentiality of your account
credentials.
- You
agree not to use another person’s account without permission.
- We
reserve the right to suspend or terminate accounts suspected of fraud,
violation of law, or breach of these Terms.
4. Role of the Marketplace
- We
provide a digital platform to facilitate transactions between Buyers and Vendors
(Sellers).
- We
are not the manufacturer, supplier, or owner of most products
listed (unless specifically marked as sold directly by us).
- Contracts
of sale are directly between Buyers and Vendors.
- We
are not liable for product defects, misrepresentations, or delivery issues
except as required by Jordanian law.
5. Seller Obligations
Sellers must:
- Provide
accurate descriptions, pricing, and availability of products.
- Ensure
compliance with Jordanian laws, including consumer protection,
import/export regulations, and tax requirements.
- Not
list prohibited or restricted items (e.g., counterfeit products, illegal
substances, firearms, endangered species).
- Deliver
products within agreed timelines and ensure reasonable packaging.
- Issue
valid receipts or invoices when required under Jordanian law.
6. Buyer Obligations
Buyers must:
- Provide
accurate delivery information.
- Pay
for products or services in accordance with the agreed payment method.
- Not
use the Platform for fraudulent transactions.
- Inspect
products upon delivery and raise disputes within the specified timeframe.
7. Payments & Fees
- Payments
may be made via credit/debit card, e-wallets, Cliq, cash on delivery, or
other methods supported in Jordan.
- The
Platform may charge Vendors a commission or listing fee, as disclosed at
the time of registration.
- All
prices are displayed in Jordanian Dinars (JOD) unless otherwise stated,
inclusive sales tax.
- Sellers
are solely responsible for reporting and paying applicable taxes to
Jordanian tax authorities.
8. Shipping & Delivery
- Delivery
terms are set by Sellers, unless managed by the Platform’s logistics
partners.
- Estimated
delivery dates are for guidance only and not guaranteed unless explicitly
stated.
- Risk
of loss transfers to the Buyer upon delivery, unless otherwise required by
Jordanian law.
9. Returns, Refunds & Disputes
- Buyers
may request returns or refunds in accordance with Jordanian Consumer
Protection Law (No. 7 of 2017) and Platform policies.
- Sellers
must honor return/refund requests for defective, damaged, or
misrepresented products.
- Refunds
are processed via the original payment method unless otherwise agreed.
- Disputes
between Buyers and Vendors “Sellers” should first be resolved amicably;
unresolved disputes may be escalated to the Platform.
10. Prohibited Uses
Users may not:
- Engage
in fraudulent, deceptive, or illegal activity.
- Post
offensive, defamatory, or misleading content.
- Infringe
on intellectual property rights.
- Attempt
to hack, disrupt, or misuse the Platform.
11. Intellectual Property
- The
Platform, logo, design, and content are protected by copyright, trademark,
and related laws in Jordan and internationally.
- Sellers
retain rights to their own product content but grant the Platform a
license to display it for marketing and sale purposes.
12. Privacy & Data Protection
- We
process personal data in accordance with Jordanian data protection laws
and our Privacy Policy.
- By
using the Platform, you consent to the collection, use, and storage of
your data as described in our Privacy Policy.
13. Limitation of Liability
- To
the maximum extent permitted by Jordanian law, we are not liable for
indirect, incidental, or consequential damages arising from use of the
Platform.
- Our
liability, if any, is limited to the amount of commission or fees we
earned from the disputed transaction.
14. Termination
- We
may suspend or terminate access if a User breaches these Terms or violates
applicable laws.
- Users
may close their accounts at any time, provided all pending transactions
are settled.
15. Governing Law & Jurisdiction
- These
Terms shall be governed by and construed in accordance with the laws of
the Hashemite Kingdom of Jordan.
- Any
disputes shall be subject to the exclusive jurisdiction of the courts of
Amman, Jordan.
16. Amendments
We may update or amend these Terms from time to time. Any
changes will be posted on the Website and will become effective upon posting.
Continued use of the Platform after updates constitutes acceptance of the
revised Terms.
